How should we calculate the cash equivalent of holidays untaken when an employee leaves?
Should each day of holiday not taken be paid in cash as -
a) 1/5th of a week’s pay
or
b) 1/365th of a year’s pay?

Mangala, thanks for getting in touch. We’ll look in to writing an article (or more) on Land Law and Landlord & Tenant Law. They’re always interesting topics.

I arrived at work to find the server had gone down. Shortly after my line manager rang from home and asked me to go home and treat the day as a day of my annual holiday allowance. I refused.
I had not been asked not to turn up that day.
Can employers effectively avoid paying wages during production hold ups by this means?

Mike,
Thanks for suggesting this topic; we’ll look in to writing an article. As for your specific issue, I’m afraid we can’t give advice without you instructing us and sending a copy of your contract. If you want to do so, please use the contact information at the very bottom of this page.

I really raised the issue in the abstract with a view to informing myself and others generally rather than asking for personal advice.
Your reply for which I thank you raised a wry smile.
After nearly four years I have still not managed to get a Statement of Particulars and have now been sacked with six months’ notice for reaching 65.
It’s a lesson in how employment law is needed.
